Contempt & Enforcement Actions in Family Law

When a person fails to comply with a family law court order — be it child support, spousal support, a parenting plan, the distribution of marital property, or some other matter — he or she may be subject to legal measures by the court. These measures are used to make the person comply when it is deemed that he or she is fully capable of doing so.

The two measures that can be used to create compliance are:

  • Contempt, which involves placing the person in civil or criminal contempt of court, which may incur fines and/or jail time until the person complies with the order
  • Enforcement, which allows the judge to enforce the court order through a variety of means, such as through money judgments, wage garnishment, or liens placed on property to satisfy support payments, or through the suspension of professional licenses or drivers’ licenses or other penalties used to create compliance
